32Red Online Casino Stays True With Trademark Dispute Win


32Red’s brand has established itself as one of the most valued in online gaming and has for many years. As a respected online casino and winner of various awards for excellence and commitment to player satisfaction the online operator recently won a trademark dispute with California company Baysound LLC over the 32x.com domain.

Similar to the trademark dispute with William Hill over the 32 Vegas and 32V domains that was infringing upon 32Red’s European Community Registered Trade Marks, Baysound LLC operated an egaming affiliate portal that lead potential visitors to believe unfavorably against the online casino.

World Intellectual Property Organization (WIPO) explained, “It is unlikely that the Respondent, being involved in the online gaming industry and with casino gaming affiliates, was not aware of “www.32red.com” as an online gaming website in 2006 and that the choice of “ 32x”’ was merely coincidental.”

Further stating, “The Panel’s view is that the Respondent intentionally acquired the Domain Name to attract, for commercial gain, Internet users to the Respondent’s website by creating a likelihood of confusion with the Complainant’s trade mark as to the source of the Respondent’s website and the gaming services provided therein.”

Baysound LLC has been ordered to transfer the 32x.com domain to 32Red subsidiary Trafalgar Media Ltd following the findings of the WIPO.
